TERMS AND CONDITIONS FOR BUYING DIGITAL 3D FILES

Shapeways, Inc. (“Shapeways”) provides a marketplace (the “Marketplace”) on its website www.shapeways.com (the “Shapeways Website” or “Website”) which, in part, allows users to buy and sell 3D files (“3D Files”). The following are terms and conditions (the “Terms and Conditions”) of a legal agreement between you (the “Buyer”) and the seller (the “Seller”) governing the purchase of a 3D File. Shapeways is not a party to the 3D File purchase transaction between the Buyer and the Seller, and assumes no liability for any acts or omissions of the Seller.
- Rights, Obligations and Representations of the Buyer
The Buyer may not use the 3D File, downloaded from this site in a manner that infringes the intellectual property of any third party or otherwise violates any applicable law or regulation. The Buyer may not reverse engineer any 3D File and must comply with the Standard Digital File Store License (the “License”).
Buyers do not own any 3D File, but rather are only licensed to use it in accordance with the License. The Seller retains ownership and copyright of the 3D File.
The license to use the 3D File is non-exclusive, non-transferable and is granted only to the original Buyer. For the avoidance of doubt, if a Buyer is a legal entity, the license is granted to a legal entity and the 3D File can be shared within the legal entity.
All purchases of 3D Files are sold as-is, final and non-refundable, unless the 3D File does not match its description or 3D rendering, as determined by Shapeways in its sole discretion. If a refund is issued, Buyer is legally bound to destroy all copies of the purchased 3D File without the right to keep or use them in the future. It is Buyer’s responsibility prior to purchase to ensure that the model is compatible with Buyer’s software.
